In Houston and throughout Texas, child support is determined by statutory guidelines which can be challenging to navigate without legal help. Texas calculates child support based on what is known as the “percentage of income” model. In essence, support is a percentage of the noncustodial parent's income, ranging from twenty percent for one child to thirty-five percent if there are four or more children. There are very few allowable deductions from gross income for purposes of calculating child support
The amount of income that is considered for purposes of calculating child support is capped, which means child support payments are also capped. However, if circumstances that warrant an award of child support greater than the capped amount can be proven, the court may adjust the award upward.
You may be paying—or receiving—child support for years, and your circumstances, or that of your ex-spouse or children, may change. A parent paying child support may need to file for a modification if income goes down; a parent who is supposed to receive child support may need to enlist the court's help in enforcing a child support order.
